2ND QTR 2020 Property Tax Grace Period until June 1st

RESOLUTION OF THE TOWNSHIP OF WEST MILFORD, COUNTY OF PASSAIC AND STATE OF NEW JERSEY, INSTITUTING A GRACE PERIOD THROUGH JUNE 1, 2020 FOR PAYMENT OF SECOND-QUARTER PROPERTY TAXES DUE MAY 1, 2020 PURSUANT TO EXECUTIVE ORDER 130

 

            WHEREAS, pursuant to N.J.S.A. 54:4-66(a), second-quarter property taxes in the Township of West Milford are due May 1, 2020; and

 

WHEREAS, on April 22, 2020, absent any tax relief from the State for Township property owners under financial hardship from the COVID-19 Public Health Emergency and State of Emergency, the Township adopted Resolution 2020-168, which reduced the interest rate on delinquent second-quarter property tax payments from 18% per annum to 3% per annum from May 1, 2020 until June 30, 2020; and

 

WHEREAS, on April 28, 2020, Governor Phil Murphy signed Executive Order 130, which authorizes municipalities to institute by resolution a grace period concluding on a date no later than June 1, 2020 for the payment of second-quarter property taxes due May 1, 2020; and

 

WHEREAS, Executive Order 130 expressly prohibits the Township from enacting or enforcing any conflicting order, rule, regulation, ordinance or resolution, including providing any additional extension of the installment date or grace period for the payment of property taxes or to otherwise temporarily fix, reduce, or retroactively modify the rate of interest charged for failure to make timely payment to achieve this effect; and

 

WHEREAS, Resolution 2020-168 as a result of the Governor’s executive order, must therefore be rescinded; and

 

WHEREAS, while the Township must still meet its continuing financial payment obligations to the County of Passaic and local board of education, the Administration has taken the necessary financial steps to accommodate the extension of the second-quarter payment to June 1, 2020, the latest date permitted by law; and 

 

WHEREAS, the Township Council finds it in the best interest of the Township to institute a grace period to June 1, 2020, to provide relief to property owners who may be incurring financial hardship during the COVID-19 emergency.

 

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of West Milford, in the County of Passaic and State of New Jersey, as follows:

 

  1. In accordance with Executive Order 130, the Township of West Milford hereby rescinds Resolution 2020-168, adopted on April 22, 2020.

  2. The Township institutes a grace period through June 1, 2020 for the payment of second-quarter property taxes.

  3. In the event taxes are not paid by June 1, 2020, the Township is obligated to assess applicable interest and penalties as set forth by law.

  4. The Township Clerk shall notify the Director of the Division of Local Government Services in the Department of Community Affairs of this Resolution no later than the third business day following its adoption.

     

    This Resolution shall take effect immediately.
